This Liability Waiver (“Waiver”) is entered into by and between Peptide Caviar (“Company,” “we,” “our,” or “us”) and the purchaser (“Buyer,” “you,” or “your”) of research-use-only products.
By purchasing, accessing, accepting delivery of, or using any products from Peptide Caviar, you acknowledge and agree to the terms set forth below.
Research Use Only
All products sold by Peptide Caviar are strictly intended for:
- Laboratory research, analytical, and scientific purposes only
Products are NOT:
- For human consumption
- For veterinary use
- For clinical, diagnostic, or therapeutic applications
Buyer Representations & Warranties
By purchasing from Peptide Caviar, you represent and warrant that:
- You are a qualified professional, researcher, institution, or entity with appropriate knowledge, training, and facilities
- You are legally permitted to purchase and use research chemicals in your jurisdiction
- You will use all products strictly for lawful research purposes in compliance with all applicable laws and regulations
- You understand the hazardous nature of chemical compounds and accept full responsibility for their handling
Assumption of Risk
You acknowledge that research compounds and chemical reagents may present inherent risks, including but not limited to:
- Toxicity and chemical exposure
- Contamination risks
- Improper storage hazards
- Unknown or unpredictable research outcomes
You voluntarily assume all risks associated with the purchase, storage, handling, and use of products.
Release of Liability
To the fullest extent permitted by law, you hereby release, waive, and discharge Peptide Caviar, including its owners, officers, employees, contractors, and affiliates, from any and all liability, claims, demands, or causes of action arising out of or related to:
- Personal injury, illness, or death
- Property damage
- Financial loss or regulatory consequences
- Improper, unauthorized, or unlawful use of products
Indemnification
You agree to indemnify, defend, and hold harmless Peptide Caviar and its affiliates from any and all claims, damages, liabilities, costs, or expenses (including attorneys’ fees) arising from:
- Misuse or improper handling of products
- Violation of this Waiver or our Terms of Service
- Violation of any applicable law or regulation
- Claims brought by third parties related to your use of products
No Warranties
All products are provided “AS IS” and “AS AVAILABLE”, without any warranties, express or implied, including:
- Merchantability
- Fitness for a particular purpose
- Accuracy, reliability, or completeness
Peptide Caviar does not guarantee results or suitability for any specific research application.
Limitation of Liability
To the maximum extent permitted by law:
- Peptide Caviar shall not be liable for any indirect, incidental, special, or consequential damages
- Total liability shall not exceed the amount paid for the product(s) giving rise to the claim
Compliance & Legal Responsibility
You are solely responsible for:
- Ensuring compliance with all local, state, federal, and international laws
- Proper licensing, permits, or approvals required for use
- Safe handling, storage, and disposal of all products
Governing Law & Jurisdiction
This Waiver shall be governed by the laws of the State of California, without regard to conflict-of-law principles.
Any disputes shall be resolved exclusively in:
- State or federal courts located in San Diego, California
Severability
If any provision of this Waiver is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Acknowledgment & Agreement
By purchasing, accepting delivery, or using products from Peptide Caviar, you acknowledge that:
- You have read and fully understand this Waiver
- You voluntarily accept all risks associated with the products
- You agree to be legally bound by these terms
